Cloture Fails 49 to 50. The Clarity Act Is Dead for 2026.

The Senate needed 60 votes to move the Clarity Act forward. It got 49. Republicans spent Sunday adding 126 concessions on ethics, stablecoin yield, and open source protections, and every Democrat who had spent months negotiating the bill still voted no. Zero Democrats crossed over. Four Republicans did too, for their own reasons.

Simply Bitcoin's take going in was that the ethics fight was cover, not the real objection. Once Bitcoin sits inside 401ks and pension funds through a bill like this, it is nearly impossible to walk back, and that kills the argument for a central bank digital currency. Elizabeth Warren made a different case on the floor, calling the bill a vehicle to enrich Trump's crypto ventures.

The concessions were never the issue. The bill dying was the point.


Bitcoin Priced the Loss In Before the Senate Did

Bitcoin fell to $76,220 by air time, giving back Monday's rally and sliding under $76,000 earlier in the morning. Prediction markets moved first. Polymarket odds on the Clarity Act becoming law this year sat at 82% back in February, and had fallen to 12.5% by Tuesday morning, hours before the cloture vote even opened.

That sequencing matters. Traders were not reacting to a headline, they were pricing in the same Democratic counteroffers Simply Bitcoin has been tracking on air for days, and they landed on the same read as the hosts: this bill was not surviving an election year, no matter how many concessions Republicans put on the table.

The market didn't wait for Congress to vote. It already had.

Sean Hagan, the new market analyst at Bitcoin Magazine TV, told Simply Bitcoin that roughly 40% of the politicians who attended the 2024 Bitcoin conference were Democrats, not the near-uniform Republican crowd the coverage implied. He would know. Handing out credentials to those lawmakers was literally his job that week.

That number never made it into the coverage. The conference gets remembered for one Republican nominee taking the stage, not for a room that was closer to a real political split than the current Senate floor fight over the Clarity Act would ever suggest to an outside observer.
