Trump Just Conceded Almost Everything to Save the Clarity Act

Cynthia Lummis dropped the final Clarity Act text at 10:18 last night, and Trump gave up more ground than anyone expected. He signed off on roughly 80 percent of the ethics counteroffer from Senators Thom Tillis and Ruben Gallego, letting state attorneys general enforce bans on federal officials issuing or holding digital assets. Officials now have to divest or go into a blind trust, and the old 2029 sunset clause is gone entirely.

The tradeoff shows up in the Blockchain Regulatory Certainty Act. The new text strips developers of explicit protection from prosecution under Section 1960, the same legal theory used against Tornado Cash's Roman Storm. Galaxy's Alex Thorn called it a setback for the provision's supporters. Tomorrow at 2:15pm, the Senate needs 60 votes just to keep debating, with rumors that seven of ten Democrats might come along.

Democrats got their ethics reform. Developers got left exposed.


Bitwise's CIO Says the Bottom Is In

Matt Hougan told Pete Rizzo's Bitcoin Historian podcast that the October blowout on overleveraged longs and this cycle's blowout on overleveraged shorts bookend the pullback. He's counted the Treasury blinking three times on the fiscal side, first on the yen, then the buyback, now signaling the buyback might grow again. His read: no sellers left, and the next move is up.

Bitcoin is sitting at $78,910, 37.5 percent off its high. Nico pushed back on his own 40k call live, arguing this cycle never had a euphoric blowoff top, so the brutal correction that would normally follow one never had a reason to show up either. He's betting the disillusionment right now is the same setup that preceded 2017's run from a few hundred dollars to 20,000.

Nobody who called the top is calling the bottom, and that might be the point.
